That's not how law works. If there's no precedent in law then whatever comes out of this becomes a precedent to make a law. It's not legal but it's isn't illegal either. Laws restrict more than they allow. You could use the actual legal principle that “no one can be trialed for a crime that hasn't been committed”, but that would be too smart for you to do.
